Terms of Service

General terms for the use of Boothready

1. Provider and Scope

These Terms of Service govern your use of the Boothready platform at boothready.app between you and Julian Zerback, sole proprietor (hereinafter "Provider").

They apply to both free and paid use of the functions provided for analyzing and preparing audio files.

2. Services Provided by Boothready

Boothready checks uploaded audio files for technical compatibility with selected DJ systems and provides analysis results. Analysis is always free of charge. Automated fixes are subject to the credit system described below: one credit corresponds to one fixed audio file. Filename cleanups and un-fixable files are always free and do not consume credits.

Credits can be acquired as one-time credit packs or are included without limitation in the Pro subscription plans. Credits do not expire.

The specific service description, feature scope, and limits are defined by the current product and pricing information shown on the platform.

3. Registration and Account

Certain features require a user account. Login is currently provided via OAuth (Google). You are required to provide accurate information and protect your account from unauthorized third-party access.

4. Paid Products, Term, and Cancellation

4.1 Credit Packs (One-Time Payments)

Credit packs are one-time purchases with no subscription or recurring charge. Payment is processed immediately at checkout. Purchased credits are added to the account balance without expiry and are non-refundable after delivery, except where required by law.

As credit packs constitute digital content delivered immediately upon purchase, consumers who explicitly consent to immediate delivery before the end of the withdrawal period lose their statutory right of withdrawal at that point. The relevant notice is provided during the booking process.

4.2 Founder Lifetime Access (One-Time Payment)

The Founder Lifetime offer is a one-time purchase granting permanent Pro-level access. It is available exclusively to eligible beta users as defined by the Provider. Once purchased, it cannot be cancelled or transferred. The same withdrawal notice as for credit packs applies.

4.3 Pro Subscriptions (Recurring)

Pro subscriptions (monthly or yearly) are recurring and grant unlimited credit usage for the duration of the active subscription period. Billing and subscription management are handled by the payment service provider shown during checkout.

Cancellations are possible at any time effective at the end of the current billing period. Access remains active until the period ends. Amounts already paid for the current period are not refunded, except where required by law.

4.4 General

The contract information shown during booking (checkout) is authoritative for pricing, term, renewal, and cancellation conditions.

5. User Obligations

  • You may only upload files for which you hold the necessary rights for processing.
  • Abusive, unlawful, or technically harmful use is prohibited.
  • You may not upload content that violates third-party rights or legal provisions.

In case of violations, the Provider is entitled to block content, restrict accounts, or terminate the contract for cause.

6. Availability and Changes

The Provider aims for high availability but does not guarantee uninterrupted accessibility. Maintenance, security updates, or technical disruptions may temporarily limit the service.

The Provider may further develop, modify, or discontinue features, taking users' legitimate interests into account.

7. Liability

The Provider is fully liable in cases of intent, gross negligence, injury to life, body, or health, and under mandatory product liability law.

In the event of slightly negligent breach of essential contractual obligations (cardinal obligations), liability is limited to foreseeable damage typical for this type of contract. Otherwise, liability for slight negligence is excluded.

The platform provides technical analysis and does not replace individual legal, tax, or professional advice.

8. Consumer Information

Notice pursuant to Section 36 VSBG: The Provider does not participate in dispute resolution proceedings before a consumer arbitration board and is not obliged to do so.

If consumers are legally entitled to a right of withdrawal for paid digital services, the relevant information will be provided separately during the booking process.

9. Final Provisions

The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

If you are a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction is the Provider's registered seat. For consumers, the statutory rules on jurisdiction apply.

Should any provision of these Terms of Service be or become invalid, the validity of the remaining provisions shall remain unaffected.
